Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the GoHereNow website, mobile experiences, and related services (collectively, the “Service”). The Service is operated by GoHereNow (“GoHereNow,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms.
1. The Service
GoHereNow provides a map-based platform that helps users locate participating restrooms and, where available, access them through a digital wallet and unlock flow. Participating businesses (“Partners”) control their facilities and set their own rules. GoHereNow is not a restroom owner, operator, or guarantor of any facility.
2. Eligibility and Accounts
- You must be at least 18 years old to create an account or make purchases.
- You agree to provide accurate information and keep it up to date.
- You are responsible for all activity on your account.
3. Wallet, Charges, and Payments
Some features require adding funds to a GoHereNow wallet or making a payment. When you authorize a charge, you agree to pay the displayed amount plus any applicable taxes or fees.
- All purchases are final except where required by law.
- Wallet balances are not bank accounts and do not earn interest.
- We may use third-party payment processors. Your payments are also subject to their terms.
4. Access to Partner Facilities
Partners are independent businesses. Access availability depends on the Partner’s operating hours, policies, capacity, safety concerns, and local law. A successful unlock or payment does not guarantee entry if a Partner denies access for lawful reasons.
5. User Conduct
You agree not to:
- Use the Service for unlawful, abusive, harassing, or fraudulent purposes.
- Damage, vandalize, or misuse Partner facilities.
- Attempt to bypass pricing, access controls, or security features.
- Scrape, reverse engineer, or disrupt the Service.
We may suspend or terminate accounts that violate these Terms or create risk to Partners, users, or GoHereNow.
6. Content and Intellectual Property
The Service, including branding, software, UI, and content, is owned by GoHereNow and protected by IP laws. You receive a limited, non-exclusive, non-transferable license to use the Service for personal, lawful purposes.
7. Partner Content and Listings
Partners provide their own listing information. We do not guarantee accuracy, cleanliness, safety, or suitability of any Partner facility or listing.
8. Safety and Emergency Disclaimer
GoHereNow is not an emergency service. If you are in immediate danger, call emergency services. Use Partner facilities at your own discretion.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, GOHERENOW DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOHERENOW WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE OR ANY PARTNER FACILITY.
OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO GOHERENOW IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless GoHereNow and its affiliates from claims arising out of your misuse of the Service, violation of these Terms, or conduct at Partner facilities.
12. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if needed to protect the Service or Partners.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Washington, excluding conflict-of-law rules. Any dispute will be brought in state or federal courts located in Washington, and you consent to that venue and jurisdiction.
14. Changes to These Terms
We may update these Terms from time to time. If material changes are made, we will post the updated Terms with a new effective date. Continued use after changes means you accept them.
